I've said it before and I'll say it again.......the EEOC should charge $10 to file a claim. It will cut down on all the frivilous claims and make money for the gov't. It's a win/win.

We terminated an employee for physical contact/assault after a variety of incidents over several years. The manager finally had enough and terminated the employee. The employee did not file a complaint for over a year, past teh deadline for filing, yet the EEOC investigator said they have a rule that allows late filings to be processed. What is the point of rules when they are not followed. If we said we would get around to sending in the response when we felt like it, we'd have the EEOC all over us. It is too bad the rules are not followed on both sides.

Possum - Anyone can file a baseless complaint with the EEOC and it's so frustrating. I've responded to several EEOC claims and never lost a case. Just make sure your attorney is aware of everything the EEOC rep said.

We have just gotten notice of an EEOC charge of discrimination - age & national origin. The EEOC investigator phoned me the other day to confirm our mailing address. She said this guy got laid off and he just didn't know what to do. She said that he told her he had heard rumors that they were choosing people based on their age - he is 58. She said "hopefully we can reach a settlement here for Mr. X because he is just really wanting to work."

This is ludicrous. An entire division was shut down. There are MANY people still there who are in their 50s - some even in their 70s! The supervisor who laid him off was of the same national origin!

There is no way I can believe this investigator truly believes this man has a valid complaint. It was obvious from her tone and words that she feels sorry for him and wants us to either throw money at him or give him his job back.

This woman has no business investigating EEOC complaints!!!

At least it brought to light that there are people in the EEOC (and other agencies) that are severely unqualitfied & ignorant. Self-righteousness at it's best.
Sounds like a smart judge, though.

More government incompetence. The EEOC didn't pay the legal fees - WE DID.
